Rubbish Collection Shoreditch Service Terms

These Terms and Conditions set out the basis on which we provide rubbish collection and related waste removal services in Shoreditch and surrounding areas. By making a booking, confirming a quotation, paying an invoice or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation booking the rubbish collection service or on whose behalf the booking is made.

Services means any waste removal, rubbish collection, clearance, loading, transportation or disposal service we agree to provide.

Premises means the collection address or site where the Services will be carried out.

Waste means the materials, items, rubbish or refuse that the Customer requests us to collect and remove as part of the Services, excluding any prohibited or hazardous materials.

We, us and our mean the rubbish collection service provider trading as Rubbish Collection Shoreditch.

2. Scope of Services

We provide scheduled and one-off rubbish collection, waste removal and related services to domestic, commercial and trade customers. Our Services include the loading, removal and transportation of non-hazardous waste to an authorised facility for reuse, recycling or disposal.

The exact scope of the Services, including the estimated volume or weight of Waste, access arrangements and any special requirements, will be agreed at the time of booking or quotation. We reserve the right to refuse to handle any items that are unsafe, prohibited by law or outside the agreed scope.

3. Service Area

Our primary service area covers Shoreditch and neighbouring districts. Acceptance of a booking is subject to the Premises being within an area we can reasonably service. We may, at our discretion, accept or decline bookings outside our usual operating zones or apply additional charges for extended travel, congestion or parking.

4. Booking Process

Bookings can be made by telephone, email or other communication methods we make available. To confirm a booking, you must provide accurate information, including your name, contact details, collection address, type and approximate volume of Waste, access details, preferred dates and any other relevant information.

We may provide a quotation based on the information you supply. Quotations are given in good faith but may be subject to change if, on arrival, the Waste differs in volume, type or accessibility from the description provided at the time of booking.

Your booking is only confirmed when we have accepted it and, where applicable, when any required deposit or prepayment has been received. We reserve the right to refuse any booking at our discretion.

5. Access and Customer Responsibilities

The Customer is responsible for ensuring that our operatives have safe and reasonable access to the Premises at the agreed time. This includes arranging any necessary permissions for entry to shared spaces, loading bays or private roads, and ensuring that the Waste is accessible without obstruction.

You must ensure that the Waste presented for collection matches the description provided at the time of booking and is free from hazardous or prohibited materials. You must also ensure that any fragile, valuable or non-waste items in the vicinity of the collection area are removed or appropriately protected.

If suitable access is not available, or if the Waste differs significantly from the description given, we may cancel the Service, reschedule, or adjust the price to reflect any additional time, labour or resources required.

6. Waste Acceptance and Prohibited Items

We collect general household, commercial and bulky Waste, provided it is lawful to transport and dispose of it under applicable waste regulations. We do not accept hazardous or specialist waste unless this has been expressly agreed in writing in advance and appropriate arrangements are in place.

Prohibited items include, but are not limited to, asbestos, clinical or medical waste, chemicals, solvents, gas bottles or cylinders, certain electrical items requiring special treatment, flammable substances, explosives and any other materials classified as hazardous under UK law.

If prohibited items are discovered among the Waste, we may refuse to collect them, adjust the Service, or charge additional fees for safe handling or specialist disposal where legally permissible. We may also terminate the Service if we consider there to be a health, safety or environmental risk.

7. Pricing and Quotations

Pricing for rubbish collection and removal is generally based on the volume, weight, type of Waste, access conditions, time required and any additional services requested, such as dismantling or labour-intensive loading.

Any quotation we provide before seeing the Waste is an estimate only and is subject to confirmation upon arrival at the Premises. If the actual Waste differs, we will advise you of any price change before commencing the Service. If you do not accept the revised price, we may cancel the booking and, where applicable, charge a call-out fee to cover our costs.

All prices are stated in pounds sterling and may be subject to VAT or other applicable taxes, which will be added where required by law.

8. Payments and Invoicing

Payment terms will be confirmed at the time of booking. For most domestic customers, payment is due on completion of the Service, unless prepayment has been requested. We may require a deposit or full prepayment for certain types of bookings, high volumes of Waste, or for commercial and repeat customers.

We accept commonly used payment methods as advised at the time of booking, including card payments and bank transfers. Cash payments, where accepted, must be made directly to our authorised operative and will be receipted accordingly.

For invoiced commercial customers, payment is due within the agreed credit period set out on the invoice. If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate, to suspend further Services, and to take reasonable steps to recover the debt, including the recovery of associated costs.

9. Cancellations and Rescheduling

You may cancel or reschedule a booking by giving us reasonable notice using the contact details provided when you made the booking.

If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply, unless otherwise stated in your specific booking terms. If you cancel within 24 hours of the agreed time, we may charge a late cancellation fee to cover our costs and lost opportunity.

If our operatives attend the Premises and are unable to complete the Service due to lack of access, incorrect information or other circumstances within your control, we may charge a call-out fee or the full service fee at our discretion.

We may need to cancel or reschedule the Service due to operational reasons, health and safety concerns, severe weather, vehicle breakdown or other circumstances beyond our control. In such cases, we will notify you as soon as reasonably possible and rearrange the Service at a mutually convenient time. We will not be liable for any loss arising from such cancellation or delay.

10. Performance of the Services

We will carry out the Services with reasonable care and skill, in accordance with applicable laws, environmental obligations and industry practice for rubbish collection and waste handling.

Our operatives will take reasonable steps to avoid damage to your Premises or possessions during the Service. However, you should highlight any particularly delicate surfaces, restricted access points, or potential hazards before we begin work.

We will determine the method, route and disposal facilities used to carry out the Service, at our discretion, provided that all legal requirements for waste transport and disposal are satisfied.

11. Liability and Limitations

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.

Subject to the above, our total liability to you, whether in contract, tort, negligence or otherwise, arising out of or in connection with the Services, shall be limited to the total price paid or payable for the specific Service giving rise to the claim.

We will not be liable for any loss of profits, business, revenue, contracts, anticipated savings, data, goodwill, or for any indirect or consequential loss arising out of or in connection with the Services, even if such loss was reasonably foreseeable.

We do not accept liability for pre-existing damage at the Premises, for damage caused by inherent defects or weaknesses in the property, nor for damage that could reasonably have been avoided if you had complied with your obligations under these Terms and Conditions, such as clearing access routes or protecting vulnerable items.

12. Customer Indemnity

You agree to indemnify us against any claims, losses, damages, costs or expenses we incur as a result of:

Any inaccurate or incomplete information you provide about the type, nature or classification of the Waste.

Your failure to disclose the presence of hazardous, prohibited or regulated materials.

Any breach by you of these Terms and Conditions or of applicable waste, environmental, health and safety or other regulations in relation to the Waste or the Premises.

13. Compliance with Waste Regulations

We operate in accordance with relevant UK waste management, duty of care and environmental regulations. We will take reasonable steps to ensure that Waste collected from you is transported and transferred only to authorised facilities and is processed lawfully.

By using our Services, you acknowledge your own duty of care responsibilities in relation to waste. You must ensure that the Waste you present for collection is your property or that you have the necessary authority to arrange its removal.

Where required, we may issue a waste transfer note or similar documentation. You agree to provide any information reasonably requested to enable us to comply with our legal obligations and to keep appropriate records.

14. Environmental Commitments

We seek to minimise the amount of waste sent to landfill by prioritising reuse and recycling wherever practicable. However, no guarantee is given that any particular item will be reused or recycled. The final treatment route for the Waste will depend on its condition, composition and the facilities available.

By using our rubbish collection and waste removal services, you consent to the Waste being sorted, separated and treated in accordance with our environmental practices and regulatory requirements.

15. Data Protection and Privacy

We will handle any personal information you provide to us in connection with the booking and performance of the Services in accordance with applicable data protection laws. We will only use your personal data for purposes related to the provision and administration of the Services, customer support, invoicing and, where permitted, service updates.

We will not sell your personal information to third parties. We may share limited data with service providers who assist us in delivering the Services, such as payment processors or subcontractors, subject to appropriate safeguards.

16. Subcontracting and Assignment

We may use carefully selected subcontractors or partner operators to perform some or all of the Services. This will not affect our responsibility to you under these Terms and Conditions.

We may assign or transfer our rights and obligations under these Terms and Conditions to another organisation. You may not assign or transfer your rights or obligations without our prior written consent.

17. Variations to the Terms

We may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings from the date the updated terms are made available. The version of the Terms and Conditions in force at the time of your booking will govern that particular Service.

18. Complaints and Dispute Resolution

If you are dissatisfied with any aspect of the Services, you should contact us as soon as possible with full details of your concern. We will investigate the issue and aim to resolve it promptly and fairly.

In the event of a dispute that cannot be resolved directly, both parties agree to consider reasonable alternative dispute resolution methods before commencing formal legal proceedings, where appropriate.

19. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

Both parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

20. General Provisions

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable, and the remaining provisions shall continue in full force and effect.

No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of rubbish collection and waste removal services and supersede all prior discussions, communications or understandings relating to their subject matter.
